Humana Lawsuit:  The Sixth Circuit denied Humana’s motion for reconsideration and reconsideration en banc. This means that barring any petition for writ of certiorari filed with the U.S. Supreme Court, the case will be sent back to the Summit County Court of Common Pleas for further proceedings. We believe there is a good chance Humana will seek Supreme Court review. If so, they will have 90 days from last week to file their petition for writ of certiorari. In the meantime, they will have to ask the Sixth Circuit to stay its decision sending the case back to Summit County if they want to preserve the status quo pending a Supreme Court appeal.

UPDATE:  Our lawsuit is now heading back to the Summit County Court of Common Pleas.  The OSCA will be meeting with our legal counsel on how to proceed forward in the coming weeks.
